What You Should Do Before Filing for Bankruptcy

There are some simple steps you can take to protect yourself and make it easier to obtain debt relief:

  • Stop using your credit cards for purchases.
  • Do not take out any cash advances on your credit cards.
  • Do not buy any big ticket items on credit.
  • Do not transfer property without the advice of an attorney.
  • File your tax returns on time.
  • If you are considering divorce, speak with a bankruptcy attorney to determine whether it is better to file for bankruptcy before or after your divorce

What Do You Need to File Bankruptcy

  • 6 months pay stubs or copies of other sources of income
  • 6 months profit & loss statements for business, including self employment taxes if applicable
  • 6 months bank statements
  • Copies of 3 last years of tax returns
  • A list of all balance transfers and cash advances made during the last year
  • 6 months copies of debts: credit cards, mortgage statements, car loan/lease statements, etc. We only need utility bills if they are behind. If bills are not available, provide me with an approximate list of what you have charged during the last 6 months
  • If you are a beneficiary of any trust, provide the trust document
  • If you are a member of a corporation, LLC or partnership, provide the governing documents for the organization
  • Trade in and retail value of car. Go to Kelly Blue Book to value your automobile.
  • Assessed value of home and any other real estate
  • Complete package of documents from real estate purchase or refinance within the last 4 years
  • Copy of divorce papers if within the last 5 years (property settlement, child support order, decree, findings)
  • Go to Bankruptcy Questions, enter the account I.D. "SheilaOSullivan" and enter your information
  • Complete credit counseling course
  • Watch bankruptcy video
  • Do you owe any money to the bank or credit union at which you have a savings, checking or other account? If so, the bank has the right to freeze those funds at any time up until the day of filing and take them to apply to what you owe them. If you bank with Wells Fargo whether you owe them money or not, you must remove all funds from the account the day before filing or they will freeze the funds
